Recruitment of foreign workers, which was halted due to Kovid restrictions, will resume in Qatar from Sunday, November 15.
The Ministry of Labor has announced the resumption of recruitment process, which has been suspended following the Kovid-19 restrictions. In the first phase, applications will be accepted from companies. Recruitment will be allowed only after detailed examination of the applications. Access to Qatar will be allowed only in accordance with the entry conditions prescribed by the Disaster Management Authority. Expatriates are also allowed to change jobs within 90 days from the expiration date of the Qatar Residency Permit (RP). A worker is allowed to change jobs within 90 days from the expiration date only if he is unable to renew the RP for reasons other than his own. This is as per the Ministerial Decision No. 51 of 2020 amending Sections 65 and 67 of the Implementation Rules of Act No. 21 of 2015 relating to the arrival, departure and stay of expatriates.
The new amendment is beneficial to expatriates as it stipulates that the RP period of the worker must be valid for change of employment. Expatriates can change jobs subject to conditions as per the amendment to Section 65 of the Implementation Rules. The Ministry of Administrative Development, Labor and Social Affairs should be informed about the change of employment. Article 67 Amendment provides that in the event that a worker is temporarily assigned to a major employment contract, the employer must submit another contract.
The main contract must be signed by the worker and the employer and approved by the Ministry of Labor. The new provisions have come into force from the date of publication in the Official Gazette. According to the Ministry of Labor, the Ministry of Administrative Development, Labor and Social Affairs has stated that there are certain conditions that must be met when changing jobs without an NOC.
This was made clear during a meeting between the Qatari Chamber of Commerce and the Ministry of Labor on amendments to the law announced by the Emir of Qatar, which sets the minimum wage for workers and changes the labor law.
Mohammed Hassan al-Ubaidali, Under Secretary of Labor for the Ministry of Labor, said the three conditions to be followed when changing jobs without an NOC are that the employer must be notified in advance before changing jobs, that the new hire company must not be in competition with the company currently employed, and that there is a clear understanding of if there is compensation.
Al-Ubaidali explained that the law was amended to improve the country’s labor market, including the introduction of a minimum wage. . Companies that violate the provisions of the Wage Protection System (WPS) will be banned.
